  1. Filing Reports of Alleged Copyright Violations

 

User Generated Content is the foundation of the content on Theglobalsaleshub.com (UGC). GSH does not verify that user-generated or uploaded content complies with copyright or other legal requirements. Nonetheless, you should take the action listed below if you think any of the uploaded material infringes against your copyright or a related exclusive right. Inquiring into such infractions, GSH blocks or removes content that appears to be infringing on the rights of third parties.

 

To enable us to examine your report as soon as possible and efficiently, the following information should be included in a copyright infringement notice (“Notice”):

 

  • Identify the portion of your work that is protected by a copyright and the copyright(s) you are referring to.
  • Your copyright designation(s) and/or certificate(s), together with the type (registered or unregistered).
  • Evidence of ownership of your copyright, like your registration number or a copy of your registration certificate.
  • A brief explanation of the claimed copyright infringement(s) by our user(s).
  • A clear allusion to the content of the Project, for example, that you claim is infringing and that you are asking to be removed.
  • Your full name, address, phone number, and email address.
  • a declaration expressing your sincere belief that the copyright owner, its agent, or the law does not permit use of the content in the way that has been reported.
  • A declaration made under penalty of perjury attesting to the accuracy of the information in the notice and proving that you are the owner of the copyright or the exclusive right being violated, or that you have the authority to file the complaint on their behalf.

Please take note that we will notify the person who is allegedly violating your copyright about the Notice and provide them the opportunity to comment. When enough evidence of infringement is shown, we reserve the right to remove or suspend the reported materials before hearing back from the user. We may contact you and replace the removed or deactivated content if the allegedly infringing user sends us a suitable counter-notification stating that it is okay to upload the purportedly infringing material. We shall follow 17 U.S.C. Section 512 and other relevant laws in all such circumstances.

 

Your DMCA Notice could not be effective if you don’t follow Section 512(c)(3) of the DMCA in its entirety.

 

Please be advised that you could be subject to damages (including costs and lawyers’ fees) under Section 512(f) of the DMCA if you intentionally and materially misrepresent that any content or conduct on the Website is infringing your proprietary rights.

 

 

  1. Procedures for Counter-Notification

If, within ten business days of obtaining a copy of your Counter-Notice, the party who filed the initial DMCA Notice does not file a lawsuit against you, we are permitted by the DMCA to restore the removed content. Please be advised that you could be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA if you intentionally and materially misrepresent that content or activity on the Website was removed or disabled by error or misidentification.

To facilitate a timely and efficient examination of your report, a trademark infringement notice (hence, “TM Notice”) ought to have the following:

 

  • Identifying your brand and the products or services that you want to protect your trademark rights for.
  • A printout from the relevant nation’s trademark office records indicating the registration’s current status and title, as well as your certificate of trademark registration. As an alternative, a declaration that your mark is unregistered accompanied by a court decision upholding your rights.

When enough evidence of infringement is shown, we reserve the right to remove or suspend the reported materials before hearing back from the user. We may notify you and replace the removed or deactivated content if the allegedly infringing user gives us information suggesting that it is okay to post the purportedly infringing material. We shall comply with the legislation in effect in each and every one of these situations.

 

 

  1. Persistent Violations

It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers.
